Reclamly Terms and Conditions

1. Agreement
These terms are an agreement between you and AO, a sole proprietorship operated by Dallas Mayne ("AO", "we") for Reclamly, a consumer drafting and tracking tool that finds money you may be owed (flight delay compensation, refunds, forgotten subscriptions) from your email receipts and prepares claims you send yourself, with a success fee only when money arrives. By creating an account, paying or using Reclamly you agree to them and to our Privacy Policy. You must be 18 or older.
2. Your account
Keep your sign-in details safe and tell us straight away if you think someone else has used your account. You're responsible for what happens in your account and for the people you invite to it.
3. Prices, billing and taxes
- Free to join. A success fee is charged only after money arrives or a saving starts: 25% of flight or baggage compensation; 20% of refunds, price drops and card-insurance payouts; for a subscription you cancel, 20% of the first 6 months saved. No caps. The exact fee is shown on each claim before you send it. No win, no fee. Reclamly Plus and Family members pay no success fee on events from their Plus start date on.
- You can always claim directly from the airline or merchant yourself for free (for Canadian flights under the Air Passenger Protection Regulations, through the airline or the Canadian Transportation Agency). Reclamly saves you the work; it isn't required.
Prices are shown before you pay. Subscriptions renew automatically each month (or year, if you choose yearly) until cancelled. Applicable taxes (GST/HST, US sales tax, VAT) are added where required. Payments are processed by Stripe.
4. Pausing and cancelling
You can cancel at any time from your billing page; the service continues until the end of the period you've paid for and then stops, with no further charges. Where a plan can be paused, billing stops while it's paused. We don't give refunds for partial periods unless the law requires it (for example, a cooling-off right where you live). If we pause or cancel your account (see section 9) we'll email you with the reason.
5. Acceptable use
- Don't break the law, including privacy, anti-spam (CASL, CAN-SPAM, TCPA) and consumer protection laws.
- Don't send messages to people who haven't agreed to hear from you, or keep messaging someone who opted out.
- Don't upload anything you don't have the right to use, or try to break, overload or reverse-engineer the service.
- Don't use the service to mislead people (for example fake reviews or false claims).
6. What Reclamly is and isn't
Reclamly drafts and tracks claims that you send yourself. We don't act as your representative, file claims for you or go to court, and we don't give legal advice (in some provinces representing someone in a claim can be a legal service). We can't promise a claim will succeed or how long it will take.
Payment authorization (optional, flight claims): you appoint AO as your payment agent to receive the airline's payment into the client funds account, deduct the disclosed fee and pay you the rest within 5 business days. Money in that account is held for you, not as AO's property. You can cancel before the airline pays.
You confirm the information you give is true. If you receive money for a claim, you agree to tell us (so the fee can be charged) and not to claim the same thing twice.
Your data
You own the data you put into Reclamly. You let us use it only to provide and support the service, as described in the Privacy Policy. You can export or delete it at any time.
AI features
Some features use AI. AI output can be wrong; check it before relying on it. When an AI assistant answers you (for example on a contact form or a phone call), it says so.
Suspension and termination
We may pause or close an account that breaks these terms, puts others at risk or isn't paid, after notice where reasonable. You can close your account at any time.
Disclaimers and liability
The service is provided as is. To the extent the law allows, we aren't liable for indirect or consequential losses (such as lost profits or lost data), and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have as a consumer that the law says can't be limited.
Governing law
These terms are governed by the laws of Alberta and the federal laws of Canada that apply there, and disputes go to the courts of Alberta. If you're a consumer, you also keep the protection of the mandatory laws where you live, and can bring a claim in your local courts.
Changes
We'll email you at least 30 days before a change that affects you materially. If you don't agree, you can cancel before it takes effect.
