- Not set by ANAC. Court damages (for example under the Consumer Defence Code) are case by case and not estimated here.
- Airline size, distance
- Neither affects these rights.
- Extraordinary circumstances
- The choice of rebooking or refund and the assistance duties apply whatever the cause.
Claim deadline
Resolution 400 doesn't set a claim deadline. Res. 813 applies from 2026-10-26. If the airline doesn't resolve it, use consumidor.gov.br.

If none of these rules covers your flight, the Montreal Convention (Art. 19) may still let you claim proven costs caused by an international delay, up to 6,303 SDR per passenger, within 2 years.
